WHO NEEDS IT


Employers seeking to sponsor foreign workers for permanent residency
under employment-based categories EB-2 or EB-3.

Positions that require a bachelor's degree or higher or skilled labor roles.

 

KEY REQUIREMENTS


Job Posting
The employer must conduct a detailed recruitment process to prove that no qualified U.S. worker is available for the position.

Wage Determination
The employer must offer a wage equal to or higher than the prevailing wage for the position.

Recruitment Process
Advertising the job in various platforms, including newspapers and state job banks, to attract U.S. workers.

Evidence Submission
The employer must provide documentation of recruitment efforts and reasons for not selecting U.S. applicants.
